Terms of Service and End User License Agreement (EULA)

1. Acceptance of Terms

By downloading, installing, or playing GoParty.Games, you agree to be bound by this End User License Agreement (“EULA”).

If you do not agree to the terms of this EULA, please do not download, install, or play the Game. If you have already installed the Game and do not agree to these terms, you should uninstall it.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and play GoParty.Games for your personal use.

You may record and share gameplay videos, live streams, or screenshots for personal or commercial purposes (such as monetized content on platforms like YouTube or Twitch), provided that:

• You do not claim ownership of the Game or any of its assets.
• You comply with the terms of this EULA.

3. Age Requirements

Accounts and personal data: You must be at least 13 years old to create an account, make purchases, join community features (such as Discord), or log in to the Game. Children under 13: Players under 13 may play the Game only under the supervision of a parent or legal guardian, and only through that parent or guardian’s account. Children under 13 are not permitted to log in, make purchases, or provide personal information. Teens (13–17): If you are ages 13–17 (or under the age of majority in your jurisdiction), you may log in and play, where permitted by law, but your use of the Game and purchases are still bound by this EULA and require the consent of your parent or guardian. By playing or logging in to the Game, you confirm that you meet these requirements and agree to this EULA.

4. Shared Device Usage

If you allow any other users access to the Game, including minors, you are responsible for any resulting charges or purchases and for ensuring they also comply with this EULA.

5. Ownership of Content

All rights, title, and interest in and to the Game (including, but not limited to, all graphics, artwork, code, audio, characters, environments, gameplay systems, updates, patches, expansions, downloadable content, and any other assets) are owned by New Trail Games and/or our third-party licensors.

You are granted no ownership rights by this EULA.

You grant us a non-exclusive, worldwide, royalty-free license to store, copy, process, modify and display content you submit, and to authorize our service providers to do the same, to operate the games and provide the features you use, including AI-generated results.

You must have all rights and permissions needed to submit and use photos, text and other content in our games, including permission from anyone identifiable in a photo.

6. Restrictions

You agree not to:

• Copy, modify, distribute, or create derivative works of the Game or its assets (including but not limited to source code, models, textures, or audio). This restriction does not apply to downloading, using or sharing AI-generated images made available to you through our games' download or sharing features, including for commercial purposes, subject to applicable law and third-party rights. However, you may record and share gameplay videos, live streams, screenshots, and similar gameplay content for personal or commercial purposes (such as posting monetized videos or streams) provided that:
  • You do not claim ownership of the Game or its assets.
  • You do not extract, share, or distribute the Game’s source code, models, textures, audio, or other raw assets.
  • You comply with all other terms of this EULA.
• Decompile, reverse engineer, or otherwise attempt to access the Game’s source code.
• Exploit bugs, glitches, or other unintended behavior to:
  • Bypass normal gameplay progression.
  • Access paid features without payment.
  • Obtain gameplay benefits not intended by the Game’s design.
• Use cheats, automation tools, bots, or other software designed to interfere with or manipulate the Game’s functionality.
• Attempt to circumvent, disable, or interfere with security features of the Game.
• Use the Game for unlawful, abusive, harassing, hateful, or otherwise prohibited purposes.

7. Virtual Items and Purchases

Paid subscriptions renew automatically each month until canceled. By subscribing, you authorize recurring charges for your selected plan, including any applicable taxes, as disclosed at checkout.

To cancel, open Subscriptions & Billing in your account, select 'Cancel subscription' and complete the confirmation in Stripe. Cancellation stops future renewals; access continues until the end of the current paid billing period.

The Game may include virtual currency, items, and other purchasable features:

• All purchases are final and non-refundable, unless otherwise required by applicable law. This applies even if your access to the Game is suspended or terminated due to a violation of this EULA, or if you stop using the Game.
• You receive only a limited, non-transferable, revocable license to use purchased virtual items within the Game.
• Upon suspension or termination of your account, all licenses to Virtual Items immediately terminate without compensation.
• Virtual currency and items have no real-world monetary value and cannot be exchanged, traded, or redeemed for real money, goods, or services, either inside or outside the Game.
• Purchases made through third-party platforms (e.g., Apple App Store, Google Play) are also subject to the terms and policies of those platforms. Some jurisdictions may provide additional consumer rights (such as a limited right of withdrawal), which will apply where required by law.

8. Analytics and Data Collection

GoParty.Games collects gameplay and device data to:

• Improve user experience,
• Balance gameplay,
• Analyze performance,
• Detect bugs and other technical issues,
• Support account features such as saving and retrieving player progress.

This may include information such as device details, session activity, in-game purchases, gameplay, and game progress. If you create an account or otherwise provide personal information (for example, when contacting support), it will be handled in accordance with our Privacy Policy. You may request deletion of personal or account data at any time. Please note that analytics data may still be retained to help improve the Game, and deleting account data will result in the loss of associated progress and virtual assets.

9. Feedback

If you submit feedback, suggestions, or bug reports, you grant New Trail Games a non-exclusive, worldwide, royalty-free, and perpetual license to use, modify, and incorporate your feedback into the Game or other products without any obligation to compensate you.

10. Termination

We reserve the right to suspend or terminate your access to the Game if you:

• Violate this EULA,
• Interfere with the Game’s normal operation,
• Attempt to hack, exploit, or compromise the Game in any way.

Upon termination, you must immediately cease all use of the Game and uninstall it from your devices. All rights to Virtual Items will also immediately terminate without compensation.

11. Reservation of Rights

We reserve the right to modify, suspend, or discontinue any aspect of the Game at any time, including features, virtual items, or services. We are not liable to you or any third party for exercising these rights.

12. Disclaimers

AI-generated images may contain errors or resemble copyrighted content or resemble other people. You are responsible for reviewing them before using or sharing them.

GoParty.Games is provided “as is” and “as available” without warranties of any kind, express or implied, including, but not limited to:

• Merchantability,
• Fitness for a particular purpose,
• Non-infringement.

We make no guarantees regarding uninterrupted or error-free gameplay, or that defects will be corrected. We are not responsible for delays, interruptions, or failures caused by events beyond our control, including, but not limited to, natural disasters, acts of government, strikes or labor disputes, internet or hosting outages, third-party service failures, or other force majeure events.

Some jurisdictions do not allow the exclusion of certain warranties. In such cases, our liability will be limited to the minimum extent permitted by law.

13. Limitation of Liability

To the maximum extent permitted by law, New Trail Games and its affiliates are not liable for any damages of any kind (including direct, indirect, incidental, consequential, special, or punitive damages) arising from:

• Any use of the Game,
• Inability to use the Game,
• Loss of virtual currency or virtual items,
• Any loss of, unauthorized access to, corruption of, or alteration of data related to use of the Game, regardless of the cause or theory of liability.

Your sole and exclusive remedy is to stop using the Game, except where otherwise required by applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless New Trail Games, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

• Your violation of this EULA,
• Your misuse of the Game,
• Any content you create, share, or distribute in connection with the Game.

15. Governing Law and Dispute Resolution

This EULA is governed by the laws of the State of Nevada, United States, without regard to its conflict of law principles.

Before either party may bring a claim in court, we both agree to first attempt to resolve the dispute through good-faith mediation in Clark County, Nevada. If mediation does not resolve the matter, any disputes arising under this EULA shall be resolved exclusively in the state or federal courts located in Clark County, Nevada.

Nothing in this section limits your rights under the laws of your country of residence, where applicable consumer protection laws provide otherwise.

16. Changes to This Agreement

We may update this EULA at any time. When changes are made, we will update the “Effective Date” at the top. The most recent version of this EULA can be found at: https://goparty.games/terms

By continuing to use GoParty.Games after publication of an updated EULA, you agree to be bound by the updated terms.

17. Severability and Waiver

If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of this EULA does not constitute a waiver of such right or provision.

18. Survival

All parts of this EULA remain in effect even if your account is suspended or terminated, your license is revoked, or you stop using the Game. This includes, but is not limited to, ownership of the Game and its content, rules about purchases, disclaimers, limits on liability, indemnification, protections for our company, employees, and agents, and governing law.

19. Export Compliance

You may not use or access the Game if you are located in a country subject to U.S. embargo or sanctions, or if you are on any U.S. government list of prohibited or restricted parties. You must comply with all applicable U.S. and local export control laws and regulations. By using the Game, you represent that you are not subject to such restrictions.
